The hooplah may have been expended regarding the Merck Settlement Offer, announced in November, 2007, but it is my opinion that the real fight is just starting.

I hadn't wanted to get involved in this situation until I had a look at the offer Merck was going to make me. Well, I received my papers, January 10, 2008. I read the "Release of All Claims" that was sent to me by my attorney. My reaction was immediate. I found three major reasons NOT to sign this document.

Release of All Claims: I am instructed to sign a "Release of all Claims against Merck & Co., the maker of Vioxx. This release gives me no recourse against Merck, if I am dissatisfied with the settlement they offer.

No Guarantee of Eligibility: At no time is an amount of any settlement monies mentioned nor is there any guarantee that I even qualify or am eligible for a settlement, under Merck's formula. This means that if I do not qualify, I have already signed a Release, therefore, I cannot go back and say I want to "re-litigate or re-negotiate or re-file" or anything against Merck and/or any other person, company, or party related to the Vioxx litigation.

Third Party Liens: All third party liens must be deducted from any settlement I might receive. Third party liens are Medicare, Medicaid, insurance, etc.. As mine would be well above $300,000, there would be nothing left. Even if I were to receive a settlement.

I will not be signing this settlement offer and will be practicing Patience, Patience and more Patience, no matter what Merck says or does. THEY ARE WRONG, THEY DID WRONG and THEY WERE WRONG, regarding their marketing of VIOXX.

I know if there are enough of the plaintiffs like me who hold out against Merck and our attorneys' recommendation, Merck will have no option but to expend millions/billions in defending their actions or renegotiate this settlement offer.
